Terms of Service

These terms govern use of Mapcensus, operated by Mapcensus. By using the service you agree to them. Last updated 13 September 2026.

1. The agreement

These Terms of Service (the Terms) are a binding agreement between you and Mapcensus (we, us, our). They cover your access to and use of Mapcensus and everything we provide with it - the API, the agent tool surface, this website and the documentation (together, the Service). Our Privacy Notice forms part of these Terms.

You accept these Terms by creating an account, by sending a request to the Service, or by paying us - whichever happens first. If you accept on behalf of an organisation, you represent that you are authorised to bind it, and you means that organisation. If you do not accept, do not use the Service.

Where you and we have signed a separate written agreement covering the Service, that agreement prevails over these Terms to the extent of any conflict.

3. Eligibility

You may use the Service only if you are 18 or older, or the age of majority where you live if that is higher, and have capacity to enter into a contract. You may not use the Service if you are barred from doing so under any applicable law, if you are a person described under Trade controls and sanctions, or if we have previously terminated your Account for breach.

The Service is not directed at children and we do not knowingly provide it to them.

4. Your Account

You must give an email address you control and keep it current: it is how we reach you about the Account and how you get back in. You are responsible for everything done through your Account, your API keys and your sessions, whether or not you authorised it, and for keeping those credentials secure. An API key is shown once, when it is minted; we cannot show it to you again.

A request made by software you configure is your request. If you point an agent, a script or a scheduler at the Service, its Input is your Input and its use of Output is your use.

Tell us at security@mapcensus.com promptly if you believe your Account or a credential has been used without your authority.

5. What the Service does, and who is asking

The Service retrieves information from publicly accessible Sources at your instruction and returns it to you in a structured form. You choose the subject, the place, the depth and the fields. We provide the retrieval and the structuring.

You are the requesting party. We do not select, endorse, verify or take any position on the underlying information, we do not decide what is worth asking for, and we do not act as your agent or adviser in deciding whether a particular retrieval or a particular use of Output is lawful where you are. Nothing in the Service or in these Terms is legal advice.

6. No affiliation

Mapcensus is an independent operator. We are not affiliated with, endorsed by, sponsored by, certified by, or acting on behalf of any mapping provider, search engine, directory, review platform, or any business that appears in a result. Product names, company names and marks that appear in Output belong to their respective owners and are used only to identify the subject of the data.

You will not, and will not permit or enable anyone else to:

8. Restricted purposes

Some uses are prohibited outright, whatever else these Terms permit.

We are not a consumer reporting agency, and Output is not a consumer report or a consumer file. You may not use Output, in whole or in part, as a factor in establishing an individual's eligibility for credit, insurance, employment, housing or tenancy, education, a government benefit or licence, or for any other purpose regulated by the United States Fair Credit Reporting Act or an equivalent law anywhere.

You may not use the Service or Output:

9. Output, and the rights in it

As between you and us, and provided you have paid for it, you may use, store, process and analyse Output for your own business purposes. We claim no ownership of the facts in Output.

But Output contains Third-Party Content that we did not create and do not own. Copyright, database rights - including the sui generis database right in the United Kingdom and the European Economic Area - trade marks, moral rights and other rights in Third-Party Content belong to the people and companies that hold them. We grant you no rights in Third-Party Content, because we have none to grant, and we make no representation and give no warranty that you may copy, store, display, republish, redistribute, sell or otherwise use any of it, or that doing so is lawful where you are.

Before you use Output, it is your responsibility to determine: your lawful basis under data protection law; whether copyright, database right, contract or any other right restricts the use you intend; and whether the terms of a Source restrict it. If you republish or redistribute Third-Party Content, you do so on your own account and at your own risk.

We retain all right, title and interest in the Service, its software, its schemas and the way it structures what it retrieves, and in aggregate or de-identified operational statistics we derive from running it. We do not use your Input or your Output to train models - see the Privacy Notice.

10. Output is not exclusive to you

Information the Service retrieves may be retained and used to answer later requests, including requests made by other customers, and your request may be answered using information retrieved earlier - whether for you or for someone else. Pricing reflects this.

You receive no exclusivity, no embargo and no first-use right in Output. Your Input, your Account and your activity are not disclosed to any other customer, and no customer can access another customer's results.

The documentation describes how to control how recent an answer has to be.

11. Our intellectual property, and the licence we grant you

The Service, its software, its interfaces, its documentation, its design and our names and marks are owned by us or our licensors and are protected by intellectual property law. Subject to these Terms and to your payment, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service and its documentation for your own internal business purposes while these Terms are in force.

All rights not expressly granted are reserved. You may not remove or obscure any proprietary notice, and you may not use our name, logo or marks except as Publicity allows.

12. Feedback

If you send us an idea, a suggestion or a request for the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable and transferable licence to use it for any purpose without restriction, attribution or payment. Feedback is given voluntarily and is not your confidential information.

13. Fees, Credits and taxes

Credits are prepaid units of service. They are not money, not a deposit, not a stored-value instrument, not a security and not an investment. They are non-refundable, non-transferable, carry no cash value, and may be used only to obtain services from us.

We charge for results delivered: a request that returns no results is not charged, and a request paid for on its own, without an Account, is charged its quoted price when it returns at least one result. A request that returns no rows is not charged; the payment can be presented again to retry that same request, up to 3 attempts in all, within 6 minutes of the first. Prices are published at /pricing and served at /v1/pricing, and we may change them for future purchases. The price that applies to a request is the price in force when the request is admitted.

Credit cannot be withdrawn. Value moves in one direction only: a payment becomes credit, and credit is spent on this Service. There is no withdrawal, no transfer to another Account, and no redemption for cash or for any asset.

Prices exclude taxes. You are responsible for all sales, use, value-added, goods-and-services, withholding and similar taxes on your purchase, other than taxes on our net income. If you are required by law to withhold an amount, you will gross up so that we receive what we would have received without the withholding.

We may correct a billing error, including by reversing an amount credited to an Account in error.

14. Payment on a public network

Payments settle on a public blockchain in a third-party stablecoin, through an independent settlement provider acting under its own terms.

The address shown on your Account is a deposit address - a place to send payment - and not a wallet you control, nor one we hold on your behalf. We do not custody your assets. We are not a money transmitter, exchange, custodian, broker, dealer or payment processor, and we do not accept card payments directly. Where a card option is offered it is provided by an independent regulated third party under its own terms, and your relationship for that transaction is with them.

Send only the asset and the network named on your Account page. Anything else is not recoverable by us. A transaction confirmed on a public network is irreversible, and a record of it is public and permanent - it is not something we can amend or delete. You are responsible for network fees, for the accuracy of what you send and where you send it, and for any tax consequence of paying this way.

15. Trial credit, and one account per person

A new Account may be granted a one-off amount of trial credit. It is a gift and not a purchase: it cannot be withdrawn, transferred or refunded, it may be spent no faster than a daily limit we publish, and we may decline it, limit it or withdraw it at any time and for any reason.

You may hold one account. Opening more than one in order to obtain trial credit more than once - by any means of appearing to be a different person, or to be in a different place, than you are - is a breach of these Terms. We use technical and other measures to detect this, as described in the Privacy Notice, and we may decline or withdraw service accordingly. Accounts we identify as belonging to one person may be suspended and their unused credit forfeited.

16. Data protection

For the personal data we hold about you - your Account, your address, your payment records - we are the controller, and the Privacy Notice describes what we hold, why, and for how long. A data processing addendum covering that data is available on request from privacy@mapcensus.com.

For personal data contained in Output, we and you are independent controllers. We determine the means of the retrieval; from the moment Output is delivered, you determine the purposes and means of your own processing of it. We are not your processor for Output, and no processor obligation arises by implication.

You represent and warrant that you have and will maintain a lawful basis for requesting and using personal data in Output; that you will meet your own transparency obligations, including any obligation to inform individuals whose data you obtained indirectly; that you will honour rights requests you receive about it; and that where you transfer that data across borders you are responsible for the transfer mechanism.

An individual who appears in Output may write to privacy@mapcensus.com.

17. Third-party services and Sources

The Service depends on independent providers, including for risk assessment, message delivery and payment settlement. They act under their own terms and privacy policies. We are not responsible for their acts or omissions, and their unavailability may make part or all of the Service unavailable.

The Service also retrieves from Sources we do not operate or control. We do not endorse a Source, we do not warrant that it is accurate about its own subject, and we may stop reading one at any time - including at its operator's request.

18. Notice, takedown and repeat infringers

Copyright and other rights in content. If you own or represent the owner of a right in material returned by the Service, write to legal@mapcensus.com with: identification of the work; identification of the material complained of and, if you can, the request that produced it; your name, address and contact details; a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law; a statement that the information in your notice is accurate and that you are the rights holder or authorised to act for them; and your signature, electronic or physical. We act on well-founded notices, we will tell you what we did, and a counter-notice may be sent to the same address.

Personal data. An individual who appears in data we returned should write to privacy@mapcensus.com.

Source operators. An operator who would rather we did not read their pages should write to abuse@mapcensus.com. We honour well-founded requests.

Repeat infringers. We terminate, in appropriate circumstances, the Accounts of customers who repeatedly infringe the rights of others. Nothing in this section waives any defence, immunity or safe harbour available to us.

19. Availability, changes and preview features

The Service is provided without an uptime commitment unless one is separately agreed with you in writing. We may change, add to or discontinue any part of it. Where a change materially and adversely affects a paid feature, we will give you reasonable notice if we can.

A feature identified as beta, preview or experimental is provided as is, may be changed or withdrawn without notice, and is excluded from every commitment in these Terms.

20. Suspension

We may suspend or limit your access to the Service, in whole or in part, immediately and without liability to you, where: you breach these Terms; we reasonably suspect fraud, abuse of trial credit, or unauthorised use of your Account; suspension is needed to protect the Service, another customer, or a Source; a rights holder or a Source operator makes a credible request; or the law requires it.

We will restore access once the cause is resolved, where we reasonably can. A suspension does not extend any period, and does not entitle you to a refund or to compensation.

21. Term and termination

These Terms apply for as long as you hold an Account or use the Service.

You may stop at any time, and may close your Account by writing to support@mapcensus.com. We may terminate for convenience on 30 days' notice; immediately on notice for a material breach that you do not cure within 10 days, or that cannot be cured; and immediately where the law requires it.

On termination your licence ends and you must stop using the Service. Stored results are deleted on our ordinary schedule - currently 7 days after the job that produced them. Unused Credits are forfeited where we terminated for your breach; in every other case they simply become unspendable. Either way they carry no cash value and are not refundable.

The following survive termination: Definitions, Acceptable use, Restricted purposes, Output, and the rights in it, Our intellectual property, and the licence we grant you, Feedback, Fees, Credits and taxes, Payment on a public network, Data protection, Confidentiality, Disclaimers, Indemnification, Limitation of liability, Dispute resolution, Governing law and venue and General, together with any other provision that by its nature is intended to.

22. Confidentiality

Each party may learn non-public information about the other in connection with the Service. Each will protect the other's with at least reasonable care, use it only to perform or use the Service, and disclose it only to those who need it and are bound by obligations at least as protective.

This does not apply to information that is or becomes public through no fault of the recipient, was already known to the recipient without obligation, is independently developed without use of the other's information, or is rightfully received from a third party. A party compelled by law to disclose may do so, giving the other reasonable notice where it is lawful to do that.

Your Input, your Output and your Account activity are your confidential information. The non-public parts of the Service are ours.

23. Publicity

Neither party may use the other's name, logo or marks in publicity or marketing without prior written consent. Either party may make a factual statement that the law requires it to make.

24. Disclaimers

The Service and all Output are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, conditions and representations, express, implied or statutory, including any warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty arising from a course of dealing or usage of trade.

In particular, we do not warrant that:

Every record carries the time it was read, so that you can judge its age. Do not rely on Output for any decision that requires verified information.

25. Indemnification

You will defend, indemnify and hold harmless Mapcensus, its affiliates, and their officers, directors, employees and agents from and against any claim, demand, action, proceeding, loss, liability, damage, fine, penalty, cost and expense (including reasonable legal fees) arising out of or relating to:

We will notify you of the claim without undue delay, give you sole control of its defence and settlement, and cooperate at your expense - except that you may not settle in a way that admits fault on our part, imposes an obligation on us, or fails to release us unconditionally, without our prior written consent. We may participate with counsel of our own choosing at our own cost.

26. Limitation of liability

To the fullest extent permitted by law:

They do not limit your obligations under Indemnification, your obligation to pay fees, or your liability for breach of Acceptable use, Restricted purposes or Our intellectual property, and the licence we grant you.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence. Where a jurisdiction does not allow one of these exclusions, our liability is limited to the least extent that jurisdiction permits.

The allocation of risk in this section is a fundamental basis of the agreement between us and is reflected in the price of the Service.

27. Dispute resolution

Talk to us first. If you have a dispute, write to legal@mapcensus.com setting out what it is and what you want, and give us 30 days to resolve it. Most things end here.

Arbitration. A dispute not resolved that way, and arising out of or in connection with these Terms - including any question about their existence, validity or termination - shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre under its administered arbitration rules in force when the notice of arbitration is submitted. The seat is Hong Kong, there will be one arbitrator, the language is English, and the award is final and binding.

Individually, not as a class. Disputes are resolved individually. Neither of us may bring a class, collective, consolidated or representative proceeding, and the arbitrator may not preside over one or consolidate proceedings without both parties' consent.

What is carved out. Either party may bring an individual claim in a small-claims court of competent jurisdiction, and either party may ask a court for urgent injunctive or equitable relief to protect intellectual property or to stop a breach of Acceptable use.

You can opt out. Email legal@mapcensus.com within 30 days of first accepting these Terms, giving your Account and saying that you opt out of arbitration. Opting out affects nothing else in these Terms.

Consumers. If you use the Service as a consumer and the law of your country of residence gives you a mandatory right to bring proceedings in your local courts, or to a different dispute-resolution process, nothing in this section takes that right away.

28. Governing law and venue

These Terms, and any dispute arising out of them or the Service, are governed by the laws of Hong Kong SAR, without regard to conflict-of-laws rules. Subject to Dispute resolution, the courts of Hong Kong SAR have exclusive jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

29. Trade controls and sanctions

You represent that you are not, and are not owned or controlled by or acting on behalf of, a person subject to trade or economic sanctions; that you are not located in, or ordinarily resident in, a territory subject to comprehensive sanctions; and that you will not use the Service in breach of any export control, sanctions, anti-money-laundering or anti-corruption law. We may refuse, suspend or terminate service on any of these grounds.

30. Force majeure

Neither party is liable for a failure or delay in performing an obligation, other than an obligation to pay, caused by something beyond its reasonable control - including an act of God, natural disaster, war, terrorism, civil unrest, labour dispute, act of government, epidemic, failure of a public network, utility or third-party provider, and denial-of-service attack.

31. Assignment and subcontracting

You may not assign or transfer these Terms, or any right under them, without our prior written consent; any attempt to do so is void. We may assign them to an affiliate, or in connection with a merger, acquisition, reorganisation or sale of all or substantially all of our assets. We may engage subcontractors to help provide the Service, and we remain responsible for our obligations.

32. Notices

We give you notice by email to the address on your Account, or by posting to the Service; either is effective when sent or published. Keeping that address current is your responsibility. You give us notice by email to legal@mapcensus.com, effective on receipt.

33. Changes to these Terms

We may amend these Terms. We will publish the amended version on this page with a new date. A change that materially reduces your rights takes effect 30 days after it is published, or on the later date we state - unless it is required by law or addresses a security or legal risk, in which case it may take effect immediately.

Using the Service after a change takes effect is acceptance of it. If you do not accept, stop using the Service and close your Account; unused Credits are not refundable.

34. General

These Terms, together with the Privacy Notice and anything they incorporate, are the entire agreement between us about the Service and replace every prior understanding about it. If a provision is held unenforceable, it is modified to the least extent needed to make it enforceable, or severed if it cannot be, and the rest stands.

A failure to enforce a provision is not a waiver of it. We are independent contractors: these Terms create no partnership, joint venture, agency or employment relationship. There are no third-party beneficiaries. Headings are for convenience and do not affect interpretation. If we provide a translation, the English version governs.
